These Terms of Use (“Terms”) govern access to and use of natashastaszak.com, related landing pages, and other online pages operated by Natasha Staszak Photography, LLC (“Natasha Staszak Photography,” “we,” “our,” or “us”). Together, we refer to them as the “Sites.”

By accessing or using the Sites, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Sites.

These Terms apply only to use of the Sites. Photography services, bookings, payment arrangements, image delivery, product orders, and other client matters are governed by the separate written agreement signed for those services. If these Terms conflict with a signed client agreement, the signed client agreement controls the photography services covered by that agreement.

1. Adults Only

The Sites and all related inquiry, consultation, booking, and photography services are intended for people who are at least 18 years old. By using the Sites, you confirm that you are at least 18 and have the legal capacity to agree to these Terms.

The Sites are directed to adults in the United States. They are not directed to children.

2. Website Information

We make reasonable efforts to keep the Sites clear and accurate. Website information can change as our services, availability, pricing, products, or business practices change. We can correct errors, update content, remove material, or change the Sites at any time.

Descriptions, examples, prices, timelines, and availability shown on the Sites are general information. They do not create a binding offer, reserve a date, or replace the details in a consultation, proposal, invoice, or signed client agreement.

We make reasonable efforts to keep the Sites accessible to people with disabilities, but cannot guarantee that every feature will work perfectly with every browser, device, or assistive technology. If you experience difficulty accessing any part of the Sites, please contact us at natasha@natashastaszak.com, and we will make reasonable efforts to assist you or provide an accessible alternative.

3. Inquiries, Consultations, and Bookings

Submitting an inquiry, requesting a resource, joining an email list, or scheduling a consultation does not create a client relationship or reserve a photography date.

A booking becomes final only after the required booking steps have been completed, including any signed agreement and payment required at that time. Current pricing, availability, payment terms, cancellation terms, product details, delivery estimates, and other service conditions will be stated in the applicable client documents.

Subject to applicable law, we may decline any inquiry or booking request at our discretion. This may include situations where a requested service is unavailable, outside the work we offer, unsafe, unlawful, inconsistent with our policies or professional boundaries, or otherwise not an appropriate fit for our business.

4. Ownership of Site Content

The Sites and their content are owned by Natasha Staszak Photography or used with permission. Protected content includes photographs, text, page designs, graphics, logos, videos, downloads, and the arrangement of those materials.

Copyright and trademark laws, together with other intellectual property rules, protect this content. Nothing in these Terms transfers ownership of Site content or grants a right to use our business name, logo, photographs, or other protected material except for the limited permission stated below.

Client photographs displayed on the Sites remain protected content. Their appearance on the Sites does not place them in the public domain or give anyone permission to copy, save, alter, publish, distribute, or reuse them.

5. Limited Permission to Use the Sites

We give you limited and revocable permission to access and view the Sites for personal and noncommercial use that complies with the law. This permission is not exclusive. You can print or save a copy of these Terms, the Privacy Policy, or information provided specifically for your personal preparation or reference.

Any other use requires our prior written permission. This limited permission ends automatically if you violate these Terms.

6. Prohibited Uses

You agree not to use the Sites or their content to:

  • Break any law, infringe another person’s rights, or engage in fraudulent conduct

  • Impersonate another person or provide information that you know is false

  • Copy, reproduce, republish, sell, license, distribute, display, or commercially exploit Site content without written permission

  • Download, screenshot, save, edit, remove a watermark from, or reuse a photograph except when we have expressly authorized that use

  • Collect content through scraping, crawling, bots, or other automated means, apart from ordinary indexing by public search engines

  • Use photographs, text, or other Site content to build a dataset, train an artificial intelligence system, create synthetic media, or operate facial-recognition technology

  • Test, bypass, disable, or interfere with access controls, security features, forms, Site operation, or connected systems

  • Introduce malicious code, overload the Sites, or attempt to gain unauthorized access to an account, server, or network

  • Remove or alter a copyright notice, ownership notice, credit, watermark, or other rights information

7. Information and Materials You Send Us

When you submit a form or send us information, you agree to provide information that is accurate to the best of your knowledge. You also confirm that you have the right to send any text, photograph, document, or other material you provide.

You give us permission to use submitted information and materials only as reasonably needed to respond to you, administer your request, evaluate a requested service, or provide services you have booked. This permission does not authorize us to publish your photographs, review, testimonial, or other personal material.

Please do not use a general inquiry form to send highly sensitive information, malicious files, unlawful material, or content that violates another person’s privacy or intellectual property rights.

8. Client Photographs, Reviews, and Testimonials

We display recognizable client photographs, reviews, or testimonial material only when authorized by a separate model release or other written permission. Agreeing to these Terms does not give us permission to publish your photographs or testimonial material.

Photographs and testimonials on the Sites describe individual work and experiences. They do not promise that every session, portrait, product, or personal experience will be identical. Creative results vary with the person, session choices, lighting, styling, location, selected images, and other details of the work.

9. Third-Party Services and Links

The Sites can link to or display services operated by other companies. These can include scheduling, video conferencing, payment processing, social media, maps, embedded video, client areas, or other website functions.

Third-party services have their own terms, privacy practices, availability, and security measures. We do not control their websites or content. A link or embedded feature does not mean that we accept responsibility for the third party’s conduct.

10. Privacy

Our Privacy Policy explains how we collect, use, retain, and disclose personal information connected with the Sites and our photography business. It is available through the Sites and should be read alongside these Terms.

11. Informational Content

Articles, preparation information, outfit ideas, frequently asked questions, videos, and other Site content are provided for general information. They are not medical, legal, financial, or other professional advice.

You remain responsible for decisions about your own health, safety, comfort, purchases, and participation in a photography service. Contact an appropriately qualified professional when you need advice outside the photography services we provide.

12. Site Availability and Disclaimer of Warranties

To the fullest extent allowed by law, the Sites and their content are provided “as is” and “as available.” We do not promise that the Sites will always be available, uninterrupted, error-free, completely secure, or free from harmful components.

To the fullest extent allowed by law, we disclaim warranties that are not expressly stated in these Terms or in a separate written agreement signed by us. This section does not exclude a warranty or consumer protection that the law does not allow us to exclude.

13. Limitation of Liability

To the fullest extent allowed by law, Natasha Staszak Photography and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of, or inability to use, the Sites.

For a claim arising only from use of the Sites, our total liability will not exceed the greater of the amount you paid specifically to use the Sites during the twelve months before the claim or one hundred United States dollars. Amounts paid under a separate photography agreement are governed by that agreement and are not payments to use the Sites.

Nothing in these Terms limits liability for gross negligence, intentional misconduct, personal injury caused by negligence, or another type of liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so part of this section may not apply to you.

14. Responsibility for Misuse

You agree to reimburse Natasha Staszak Photography for reasonable losses, liabilities, costs, and legal fees that result from your unlawful misuse of the Sites, your violation of these Terms, your infringement of another person’s rights, or material you submit without the right to do so. This obligation does not apply to losses caused by our own unlawful conduct.

15. Suspension or Termination

We can restrict or end access to the Sites when we reasonably believe a person has violated these Terms, threatened the Sites or another person, attempted unauthorized access, or used the Sites unlawfully. Ending access does not affect rights or obligations that arose before termination.

16. Governing Law and Location of Disputes

New York law governs these Terms, without regard to rules that would apply another jurisdiction’s law. Any court proceeding arising only from these Terms or use of the Sites must be brought in a state or federal court with jurisdiction in Erie County, New York, unless applicable consumer law requires another location.

These Terms do not take away any consumer right that cannot legally be waived.

17. Changes to These Terms

We can update these Terms when the Sites, our practices, or legal requirements change. The revised Terms will be posted with a new effective date. Changes apply from the date they are posted and do not change a separate client agreement that has already been signed.

18. General Terms

If a court finds one part of these Terms unenforceable, the remaining parts will continue to apply. Our failure to enforce a provision once does not waive our right to enforce it later.

You cannot assign your rights or obligations under these Terms without our written permission. We can assign these Terms as part of a lawful sale, transfer, restructuring, or continuation of the business.

These Terms are the complete agreement concerning use of the Sites. The Privacy Policy separately describes our information practices. A separate signed client agreement remains the complete agreement for the photography services it covers.
